Your access and use of the Service is conditioned upon your acceptance and compliance with these terms, which apply to all visitors using Swapful exchange website. You agree to bound by these terms when accessing the Service. In case of disagreement with any term, you are devoid of accessing the Service.

Purchases

For any purchase made available through the Swapful exchange website, you will be asked to provide certain purchase and banking relevant information details, including credit card number, expiration date, billing address, and bank account information to aid in verifying your identity.

After providing the relevant details, you represent and certify that: I. You can legally use credit cards or other banking channels in connection to any Purchases made using the Service. II. The information provided is true, fair, and complete.

Upon submitting the information, you allow Swapful to share the information to third-party banking organization for facilitating the purchase.

Swapful also reserves the right to terminate your order for valid reasons, including unavailability of product/service, discrepancies in product’s price or description. In case of suspicion of fraud or illegal transaction, we reserve the right to cancel the order.

Our trademark can’t be used for any product/service without written approval/consent from Swapful.

You’ll find links to third-party websites or services not owned by Swapful when accessing the Service. Furthermore, you can directly interact with third-party services without leaving the Swapful exchange website.

However, Swapful has no control and responsibility for the privacy policies of any third-party website, and you interact with them upon your sole discretion. You acknowledge that Swapful will never be responsible for any loss or damage caused by using and accessing third-party services.

Limitation Of Liability

Swapful along with its directors, employees, partners, affiliates, agents, and suppliers will never, in any event, be held liable for any indirect or punitive damages, including loss of profits, data, use, resulting from the following cases: (i) Ability or inability to access the service (ii) Any limitation arising due to third-party website on the Service (iii) Content obtained from Service (iv) Unauthorized access, use, or modification of legal documents, such as warranty, contract or tort.

You use and access Swapful at your sole discretion. The Service doesn’t have express or implied warranties, relating to merchantability, fitness for use, non-infringement, or performance.

Henceforth, Swapful and its subsidiaries doesn’t warrant that:
a) The service will function seamlessly.
b) The service will be secure and available at any time.
c) Errors will be corrected promptly.
d) The service is free from virus.
e) The results of using the Service will meet your needs.

Governing Law

The terms are governed as per Switzerland laws, without considering any conflicts relating to law provisions. Failure to implement terms provision doesn’t mean that the rights are waived off. If a particular term classifies as invalid, the remaining terms will stay in effect. These terms form the only agreement between the users and Swapful exchange website and replace former terms and condition amended in the past.

Changes

Swapful has the right to modify or replace the agreement terms at any time. If the revision is of material usefulness, we’ll give a prior notice of at least 30 days. If a user continues to use our service after revisions are incorporated into the interface, it shall be deemed that user accepts and is bound by the revised terms.

FEES FOR USING SWAPFUL SERVICES

Swapful charges fees for its services and you’ll be notified of any charges before accessing a paid service. Fortunately, you can create a wallet for free on Swapful exchange website. However, our fees are subject to change without any prior notice. For more details, See “Swapful Fees”.

NO RIGHT TO CANCEL SERVICES OR MINERS FEES

Once you confirm to proceed with a service or transaction, the service or the miner fee won’t be refunded under any circumstances.

DISCONTINUANCE OF SERVICES

At our sole discretion, we may modify or disable any part of our service without any prior notice.

PROHIBITED USE

Once you access our services, you agree to act in accordance with the terms and conditions of this agreement and privacy policy and avoid committing any unlawful act. You agree not to: • Use Swapful in any manner that could interfere or negatively affect other users from fully enjoying our Services,
• Impair the functioning of our Services,
• Engage in activities which violate law, ordinance, or regulations and sanction programs in the administered countries,

• Interfere with another user’s access,
• Defame, abuse, harass, threaten, or violate legal privacy rights (as described in the policies) of other users,
• Spread hate or pass racial comments against others,
• Try to stalk and collect information from our website about other users,
• Engage in fraudulent activities which may damage Swapful,
• Provide deceptive or inaccurate information when requested by a Service or required under the agreement,
• Try to impair the Services with virus, Trojan, worms, or logic bombs,
• Use irrelevant robot, spider, crawler, scraper to access our Services or to extract data,
• Attempt to circumvent any content filtering techniques or gain access to unauthorized service,
• Run advertisement or promotions that will redirect trading of digital assets outside Swapful exchange,
• engage in transactions that violate copyright, trademark, right of publicity or privacy or any other proprietary right under the law, or other licensed materials without the appropriate authorization from the rights holder,
• Use of Swapful intellectual property, name, or logo, without prior consent, or in a way that harms the Swapful brand,
• Engage in activities that implies wrongful endorsement by or affiliation with Swapful,
• Create third-party applications that interact with our Services without our prior written consent,
• or induce third party to engage in any of the above-mentioned activities.

FORCE MAJEURE

Swapful is not responsible for any delays and performance interruptions in services resulting from causes beyond reasonable control, including market volatility, any act of God, act of military authorities, terrorism, civil disturbance, war, labor dispute, telecommunications interruption, failure of equipment and/or software, and other conditions which are beyond reasonable control and shall not affect the validity and enforceability of any remaining provisions.

NATURE OF AGREEMENT

The Terms of Use constitutes the entire agreement and the essential terms and conditions between the user and Swapful. This agreement replaces any prior understandings and agreements between user and Swapful as to that subject matter. Furthermore, the user is directed to not assign any of your rights or obligations under this Agreement without Swapful prior written consent.
